STRANDING OF MOTORSHIP
"MALABAR."
CHARGE AGAINST THE MASTER.
The Court of Marine Inquiry held at Sydney on the 15th and 16th
April, 1931, before John William Malcolm Laidlaw, Esquire, Chief
Stipendiary Magistrate, assisted by Captains F. W. Jolliffe and G.
B. Mercer, Assessors, delivered the following decision relative to
the charge preferred against George William Leslie, master of the
motorship "Malabar," of failure of duty in a matter relating to the
navigation of the vessel, as a result of which she stranded on the
Northern side of Long Bay, New South Wales, on the 2nd April, 1931,
and became a wreck.
Captain G. D. Williams, Deputy Director of Navigation, New South
Wales, appeared for the Director of Navigation; H. E. Manning, of
Counsel, appeared for the master and owners of the "Malabar."

STATEMENT OF CASE.
The motorship "Malabar," Port of Registry, London, Official
Number 148681, of 4,512 tons gross register, George William Leslie,
master, left Melbourne on 31st March, 1931, with a complement of
109 officers and crew and 28 passengers, on a voyage to Singapore,
with Sydney, New South Wales, as the first port of call.
At about 6.35 a.m. on 2nd April, 1931, the vessel, stated as
being on a course of N. 18° E. magnetic, passed Cape Baily at a
distance of about three-quarters of a mile. About 6.45 a.m. Cape
Banks was abeam, distant about 1 mile. The weather then became
hazy, the course was stated to have been altered to N. 23° E.
magnetic, and shortly afterwards the vessel entered a dense fog
and, at about 6.52 a.m., stranded on the northern side of Long Bay
and subsequently became a total wreck.

In the matter of an inquiry as to a charge against George
William Leslie, master of the motorship "Malabar," of failure of
duty in a matter relating to the navigation of the vessel, as a
result of which she stranded on the northern side of Long Bay, New
South Wales, on 2nd April, 1931, and became a wreck.
The Court, having carefully inquired as to the said charge:
Finds the said charge proved and cancels the certificate of the
master, George William Leslie.
