(No. 1008.)

"LYTTELTON" AND "ASPASIA."

REPORT of a Court of Inquiry held at Lyttelton, New Zealand, into the collision between the steamtug "LYTTELTON" and the schooner "ASPASIA."

1. That the damage herein more particularly mentioned happened on the 27th day of February 1881, at about 1 a.m., in the Lyttelton Harbour.

2. That the damage appears by the evidence to have been caused by the tug "Lyttelton" running into the schooner.

3. That the nature of the damage done was partial, namely, head gear, &c., carried away.

And I, the said Justice of the Peace and Resident

Magistrate, further state my opinion on the matter aforesaid to be as follows:—

That the collision was the result of negligence or want of caution on the part of each vessel. That the look-out on board the "Lyttelton" was insufficient, as what is everyone's duty is no one's duty; a look-out is always needful. That the light on board the schooner was sufficient of itself, but was not hoisted where it could be best seen.

I order that the costs of the enquiry be divided.

Given under my hand, this 3rd day of March 1881, at Lyttelton, New Zealand.

(Signed)

WM. DONALD,

Justice of the Peace and Resident Magistrate.

I concur in the above report,

(Signed)

G. JENKINS,

Nautical Assessor.
